DUTY FIRST AND RIGHT LATTER UNDER LAW?

DUTY FIRST AND RIGHT LATTER UNDER LAW?

(1) The humans carry  instincts of life, like other animals and said instincts can be satisfied from means of life made  available within environment by Nature. Thus, if instincts are problems then means are solutions to such problems. It can also mean that it is problem first and solution latter. In other words, problem is mother of solution. There is also a proverb than necessity is mother of invention. The instincts are necessity and means are inventions in solutions.

(2) It can be observed that instincts of breathing, thirst and hunger are directly related to means of air, water and food respectively being means of satisfaction of such instints. All such life  instincts are basically duties to life and all such means of satisfaction of such instincts are basically rights to life. It can be seen that duties to life in the form of instincts of life have led to rights to life in the form of means of life. Thus, duty first and right latter seems to be the order of priority under law of Nature.

(3) Unfortunately, the humans have been following reverse order with their own logic of law viz. right first and duty latter meaning means first and instincts latter. This may be based on human logic that humans cannot satisfy their life instincts without having means of satisfying such instincts in their hands at first instance.

(4) The right to means of life can also be called as the right to property in general. If this is so then right to property naturally becomes fundamental right to life. Of course, such right carries fundamental duty to life. If life cannot survive without property, then right to property comes first although it is naturally true that it is the duty to life which has created such right to property. The fact remains that right and duty are both correlated to each other under law of Nature and it can be assumed that Nature might have created both instincts of life/duty to life and means of life/right to life together. -Adv.B.S.More
