SPEAKING VERSUS WRITING IN LAW!

SPEAKING VERSUS WRITING IN LAW!

(1) When you write anything, it becomes a document in itself. It is needless to state that documentary evidence is always superior to oral evidence. You can talk big without deep study, but to write big requires big study. The writing requires more care than speaking. The written expression is therefore valued more than oral expression by me as a legal draftsman.

(2) Let the big counsels shine as stars in law courts with their musical  arguments, they should mind it well that playing such music is very difficult in any written pleadings. Even the oral evidence of witnesses is recorded by law courts in writing to make it a documentary evidence.

(3) Unfortunately, the law courts need counsel arguments to deliver their  judgments even if whole written material of facts and law lies before them.  When will this judicial trend change, only God knows! -Adv.B.S.More
