मी दिवाणी वकील आहे, फौजदारी वकील नव्हे!
वकिली हा माझा प्राण! या वकिलीवर मी गेली ३२ वर्षे जीवापाड प्रेम केलेय. पण माझी ही वकिली दिवाणी आहे, फौजदारी नव्हे. माझा पिंड फौजदारी वकिलीला योग्य नाही. फौजदारी वकिली म्हटले की हिंसा आली, मग ती मानसिक हिंसा असो की शारीरिक हिंसा असो. फौजदारी वकिली करणारे वकील म्हणजे वाघ आणि दिवाणी वकिली करणारे वकील म्हणजे नेभळट असा जर कोणाचा गैरसमज असेल तर तो त्यांनाच लखलाभ. माझ्या मते तर दिवाणी वकिली ही फौजदारी वकिलीपेक्षा अवघड आहे. कारण ती अहिंसा तत्वावर आधारित आहे. पण माणूस अजूनही असंस्कृतच आहे त्यामुळे तो प्रसंगी वाघ, सिंहासारखा हिंस्त्र, क्रूर वागतो. हिंसक माणसांची खाजगी वकिली करायची म्हणजे त्यांचा कायदेशीर मार्गाने कोर्टात बचाव करायचा असेच ना! पण त्यासाठी वकिलाला अगोदर त्याचे मन हिंसक बनवावे लागेल तरच तो हिंसक माणसांचा असा बचाव करु शकेल. फौजदारी कोर्टात गुन्हा सिद्ध होईपर्यंत गुन्ह्याचा आरोप असलेला आरोपी निष्पाप असतो असा कायदा म्हणतो. पण असा आरोपी खरच निष्पाप आहे की गुन्हेगार आहे हे वकिलाला बरोबर कळते आणि आपला अशील गुन्हेगार आहे हे कळल्यावर सुद्धा त्याचा बचाव करायला कोर्टात उभे राहायचे हे कायद्यात बसत असले तरी माझ्या अंतर्मनाला पटत नाही. म्हणून मी गेली ३२ वर्षे माझ्या मनाला पटणारी दिवाणी वकिली करीत आहे.
दिवाणी वकिली करीत असताना सुद्धा माझी काही गुन्हेगारी प्रवृत्तीच्या माणसांशी गाठ पडली, नाही असे नाही. पण मी सावधपणे त्यांच्यापासून बाजूला झालो. त्यांना माझ्या दुस-या ओळखीच्या फौजदारी वकिलांचा संदर्भ सुद्धा दिला नाही. पण जिथे खरोखर एखाद्या निष्पाप माणसावर खोटी फौजदारी केस केवळ त्याला त्रास देण्याच्या कुहेतुने लावली असेल त्या ठिकाणी मात्र मी माझ्या काही ओळखीच्या फौजदारी वकिलांची मदत घेवून त्यातले सत्य बाहेर काढून निष्पाप माणसाला न्याय देण्याचा प्रयत्न केला. पण अश्या फौजदारी केसेस मध्ये माझे वकीलपत्र मात्र दाखल केले नाही. माझा दिवाणी वकिलीचा अनुभव असा आहे की अश्या केसेस मधील अशील कदाचित फसवे असतील, ते मला माझ्या वकिलीची फी सुद्धा अगदी कमी देतील, पण ते खुनशी मात्र नसतात. फौजदारी वकिलीत मात्र खुनशी माणसांशी जवळून संबंध येऊ शकतो. अश्या माणसांशी संबधच नको, कारण असंगाशी संग प्राण कंठी आले अशी गत होवून जाते अश्या संबंधात.
माझी दिवाणी वकिली ही जास्तीत जास्त कंपन्या, व्यापारी यांच्या बरोबर झाली. त्यामुळे तर मी कसाबसा वकिलीत टिकाव धरू शकलो. मला वाकडीतिकडी वकिली जमलीच नाही व यापुढेही जमणार नाही. माझी ही दिवाणी वकिली कोणत्या स्वरुपाची होती हे आज मी समाज माध्यमावर जाहीर करून टाकतो. त्यासाठी मी या लेखाखाली माझा इंग्रजी भाषेतला बायोडाटा देत आहे. त्याचे मराठीत भाषांतर करीत बसत नाही. कारण तेवढे इंग्रजी मराठी माणसांना येते. मराठी माणसे इंग्रजीत मागे नाहीत हे मी माझ्यावरून सांगतो. मराठी माध्यमातून शिक्षण घेऊनही मी इंग्रजी माध्यमातून शिक्षण घेतलेल्या माणसांबरोबर फाडफाड इंग्रजी बोलू शकतो, लिहू शकतो. हा बायोडाटा ही माझी बायोग्राफी आहे म्हणजे माझ्या आत्मचरित्राचा भाग आहे. तो माझ्या दिवाणी वकिलीचा इतिहास आहे. तो बायोडाटा मी माझ्या उतार वयात वकिलीची कामे मिळण्यासाठी केलेली जाहिरात नव्हे. मला असली जाहिरात करण्याची काहीही गरज नाही. थोडे तत्व बाजूला ठेवले तर आताही मला घरबसल्या भरपूर कामे मिळू शकतात. पण तत्वाने जगलोय, आता कशासाठी तत्व सोडू?
आता यापुढे मी माझे वकीलपत्र कोणत्याही वकिलाने त्याच्या ओळखीतून मिळवलेल्या दिवाणी कामात सुद्धा दाखल करणार नाही, संयुक्त वकील म्हणूनही नाही. फौजदारी वकिलीत तर असे वकीलपत्र दाखल करण्याचा प्रश्नच नाही कारण मी मुळातच फौजदारी वकील नाही. परंतु माझ्याकडे जर कोणावर अन्याय झाल्याची फौजदारी केस आली तर माझ्या ओळखीच्या फौजदारी वकिलाची मदत घेईन व त्यालाच त्या केस मध्ये त्याचे वकीलपत्र दाखल करण्याची विनंती करेन. फीचे काय करायचे ते आम्ही आपसात ठरवू. परंतु माझ्याकडे जर दिवाणी केस आली तर मात्र इतर ओळखीच्या दिवाणी वकिलाबरोबर त्या केस मध्ये संयुक्त वकीलपत्र दाखल करीन किंवा कोर्टाबाहेरील काम असेल तर त्यात संयुक्त भागीदारी करेन. तिथेही फीचे काय करायचे ते आम्ही आपसात ठरवू. कृपया हे लक्षात घ्या की, ही माझ्या वकिलीची जाहिरात नसून हा माझ्या तमाम ओळखीच्या किंवा समाज माध्यमावरील माझ्या थेट संपर्कात न आलेल्या वकिलांशी साधलेला हा जाहीर संवाद अर्थात माझे जाहीर मनोगत आहे. गेले काही दिवस मी आता माझ्या जुन्या वकिलीतून मोकळा झालोय हे कळल्यापासून काही फेसबुक मित्रांकडून मला त्यांच्याकडे असलेल्या काही कामाच्या ऑफर्स मला दिल्या ज्या माझ्या तत्वात म्हणा किंवा माझ्या साच्यात म्हणा बसल्या नाहीत. म्हणून मी यापुढे सावकाश, संथ गतीने कोणत्या प्रकारे वकिली करणार आहे याचा जाहीर खुलासा करावा लागतोय. माझी यापुढील वकिली ही बहुतेक घरूनच कायदा सल्लागार स्वरुपाची असेल. पण ही वकिली फुकटात करणार नाही हे मी जाहीर करून टाकतो. पण एखाद्या मोठ्या अशिलाने जास्त पैसे फी म्हणून दिले तर त्याच्याकडे काही तासांची भेट देवून हेच काम तिथे जाऊन करणार. पण त्यासाठी त्या अशिलाने मला वेगळा संगणक टायपिस्ट तिथे द्यावा लागेल कारण मी स्वतः टायपिंग करणार नाही. मला मराठी व इंग्रजी दोन्हीही संगणक टायपिंग येते पण तरीही करणार नाही. अशिलाच्या दारात जाऊन टायपिंग न करणे हा माझ्या वकिली रुबाबाचा भाग आहे.
तेंव्हा मित्रांनो, माझा खालील इंग्रजीतील बायोडाटा नीट वाचा व त्याप्रमाणे माझ्याशी बोला किंवा संपर्क साधा. नसेल तर आपली मैत्री लांबूनच आहे तिथेच राहूद्या. मला माझ्या उतार वयात जास्त धावपळ सोसायची नाही व करायचीही नाही. आता मला कोणत्याही राजकीय पक्षाचे किंवा सामाजिक संस्थेचे सन्माननीय पद सुद्धा नको, हे मी आज जाहीर करीत आहे.
